One of the main things I would like to be assured of is that as its an Independent Supporters Club, the committee is aware that they are responsible for reporting to its  members and not Mr Cleeve.

Hopefully he will not try to assert any pressure on them. If he wants something from them it should be in the form of a request and not a demand. Presumably before any  large ticket items are purchased, the members will be approached for their approval.

The friends are soon to have their own website and yes we are fully Independent of the Club.  The committee are Chairman Malcolm Hill,Treasurer Matt Hanney Secretary Josh Yates,Membership Secretary Barry Fysh ,Committee Members Mark Mortimer,Mark Mallows ,Matthew Green.John Flanagan

When asked who is in charge of fund raising all the fotlsc committee are,and all of the fans

Whilst this may be true in its widest sense, fundraising doesn't happen 'on its own' and generally needs to be co-ordinated and, in my experience, preferably by an individual who co-opts others for specific tasks rather than 'by committee'. 

Please could you give a summary of the current fundraising schemes that are up and running?  I know you are a new committee still finding it's feet but you have had two meetings since the AGM and the first home game is tomorrow and whilst transparency as to how the FOTL operates and where fundraising proceeds are directed is a laudable aim it is a bit irrelevant if fans are not aware of the various fundraising schemes - better to inform and publicise, not wait for fans to ask.

B&G, the FOTL isn't set up in the same way as the Blue & Gold Trust in many ways (no statutory regulation, different ethos, different constitution, etc) so I don't think the members 'need' to be approached for approval of funds being moved to the club, indeed in many cases this movement is explicit in the promotion of the fundraising activity ie 12th Man was promoted specifically for player budget so it would seem unnecessary to then ask members when this money is given to the club.

I think the onus is on the FOTL committee to have a good handle on these sorts of questions prior to the meeting on the 7th September and people can then make informed decisions on a) joining and b) which activities they are going to support

Yes, I'm well aware of the difference between a Supporters Club and a Trust.

A club is simply a group of people who have a common cause or interest-such as supporting a football club. They are classed as an “unincorporated association” and the have no legal identity of its own, unlike a Trust. As a result they can only act through their officers, or other authorised members of its management committee.

The rules of a club (often called its constitution) are critical; they determine how the officers and other management committee members of the club are appointed, and what powers they have. If  the rules aren’t followed then potentially the committee members aren’t appointed lawfully, and so their actions may not be lawful either.

This could result in the committee members being personally liable for the actions of the club.

The committee of the club must carry out the expressed wishes of the MEMBERS.

So, the FOTL's Supporters Club committee members can be held legally responsible, just like Trust committee members are.

Regarding the 12th man example. Yes, you would like to think the committee would be capable of arranging that kind of thing without asking for permission of its members first (although reporting back on the matter would be important), but I did actually mention "big ticket items".

If they are not prepared to go to their members on such matters as major expenditure then I believe the Committee members will experience problems ahead and it could also affect the take up of new membership.
